The Missouri Western District Court of Appeals today affirmed a trial court order permanently enjoining the performance of a lease of nearly 1,000 acres of farmland in Bates County, Missouri. The trial court had found that the successor trustees of the Millard Cook trust had acted arbitrarily and for an improper purpose when they leased the farmland to Bill and Sharon McElwain. The Western District affirmed that decision.
