Collins & Jones, led by its appellate litigator Jeff King, argued before the Missouri Court of Appeals to protect private business against unconstitutional subsidies by the Missouri Department of Conservation. The case, Swallow Tail v. Missouri Department of Conservation, involves millions of dollars in taxpayer-funded assistance provided by MDC to a private corporation. This private entity uses the MDC aid to create and sell compensatory mitigation credits in competition with Swallow Tail and other businesses. Collins & Jones argued to the Court that this MDC-sponsored mitigation work does not help the environment, but instead uses taxpayer dollars to choose winners and losers between private competitions. The parties expect a decision from the Court of Appeals for the Western District in the next few months.
